Family Law: Modifications [concerning child support, visitation issues, parental rights]

Many people assume that once they are divorced that the issues that were decided in their divorce decree are final. Unfortunately too many people find out the hard way that this is not true.  It may be possible in Texas after a divorce has been finalized for one parent to go back to court and get virtually any portion of their divorce decree modified in their favor.  The most common portions of a divorce decree that a party will attempt to modify include:

  • Child Support
  • Visitation
  • Parental Rights
  • Residency of the Child

Whether a judge allows a party to have portions of a divorce decree modified will depend on many factors such as:

  • The Best Interests of the Child
  • A Substantial Change in Circumstances (since the divorce was finalized)
  • The Amount of Time Since the Divorce was Finalized

If you want to know if you can have your divorce decree modified, or are worried about your ex-spouse gaining a successful modification, our experienced team of family law attorneys can help.   They know Texas family law and have the advocacy skills to put their knowledge to good use in the courthouse.
